Terms of Use
This Terms of Use Agreement (this "Agreement") contains the terms and conditions of a legal agreement between you and Muy Mucho Group, LP and its affiliates ("Muy Mucho"). This Agreement contains the entire agreement between you and Muy Mucho with respect to your access and use of: (1) Muy Mucho's website (the "Site"); and (2) the Chili's® mobile application when used in connection with purchasing goods and services from a Chili's® Grill & Bar restaurant owned and/or operated by Muy Mucho (collectively referred to herein as the "Muy Mucho Sites"). Muy Mucho is a licensed franchisee of Brinker International, Inc., its subsidiaries and affiliates ("Brinker"), and use of the Muy Mucho Sites may also involve use of and access to Brinker's Chili's® Grill & Bar websites and the Chili's® mobile application (the "Brinker Sites"), and content and proprietary data of Brinker. Your access to and use of the Brinker Sites and information contained thereon is also subject to your agreement to Brinker's Terms and Conditions, available on the Brinker Sites.
Applicability and Acceptance of these Terms of Use
By viewing, using, accessing, browsing, and/or submitting any content or material on the Muy Mucho Sites, you agree to all terms and conditions of this Agreement as a binding legal agreement between you and Muy Mucho, without limitation or qualification. The terms "you" or "your" shall refer to any person or entity who views, uses, accesses, browses and/or submits any content or material on the Muy Mucho Sites. If you do not agree to every term and condition of this Agreement, then you may not use the Muy Mucho Sites.
You agree that each visit you make to the Muy Mucho Sites shall be subject to the then-current Terms of Use, and continued use of the Muy Mucho Sites now or following any modifications to this Agreement confirms that you have read, accepted, and agreed to be bound by such then-current Terms of Use and/or modifications to this Agreement. You agree not to use the Muy Mucho Sites: (1) if you are under the age of eighteen (18); (2) to purchase alcohol unless you and the alcohol recipient are age twenty one (21) or older and present a valid photo ID at the time of purchase and delivery; and/or (3) using any other person or entity's account, registration, personal or financial information, passwords and/or IDs.
THE CONTENT OF THIS SITE IS NOT DIRECTED AT CHILDREN UNDER THE AGE OF 13 AND MUY MUCHO DOES NOT KNOWINGLY COLLECT PERSONAL INFORMATION FROM ANY CHILD UNDER THE AGE OF 13 ON THE MUY MUCHO SITES.The Muy Mucho Sites are to be used only by individuals aged 18 and older- if you are under the age of 18, you must ask your parent or guardian to assist you in using our websites.
Access to and Use of Content
By accessing the Muy Mucho Sites, you will have access to a variety of resources and information, including but not limited to: products; services; location data; web pages; postings; links; files; images; data; messages; text; images; graphics; nutritional information, pricing information, and other services (collectively referred to as the "Content") in which you can view, upload, download, email, post, publish, transmit, and access information contained on the Muy Mucho Sites. By downloading, accessing and using the Muy Mucho Sites, you agree to follow and be bound by all terms and conditions of this Agreement, concerning your access to and use of the Muy Mucho Sites, the Content, and the Third Party Content provided, as set forth herein.
The Content is intended to convey general information about Muy Mucho and its Chili's® Restaurant Grill & Bar restaurants (collectively, the "Restaurants"), and to provide you with access to information about goods, services, offers, discounts, promotions and/or specials offered at the Restaurants as well as providing you with the ability to purchase Muy Mucho's goods and services online. The Content shall not be construed as professional or legal advice but is intended for general information purposes only and may not be quoted or referred to in any other publication or proceeding without the prior written consent of Muy Mucho. The views set forth on the Muy Mucho Sites are the personal views of the author and do not necessarily reflect those of Muy Mucho.
Content concerning the menus, pricing, hours of operation, accessibility, nutritional information, guidelines, parking or other information concerning the Restaurants and/or the goods and services provided by Muy Mucho are all subject to change, without notice, and Muy Mucho assumes no liability or responsibility to you for any errors or omissions in such Content.
Gift Cards
Brinker Services Corporation, a subsidiary of Brinker, provides gift card services to the Brinker International system of restaurants and to any other participating restaurant systems (such as On The Border Mexican Grill & Cantina® and Romano's Macaroni Grill®. No service fees are changed on gift cards. Gift cards should be protected like cash by the purchaser or holder of the gift card, and all sales are final- lost or stolen gift cards will not be replaced, and returns are not accepted. Further, gift cards may not be resold for less than face value. By ordering gift cards through the Muy Mucho Sites or Brinker Sites, any resellers of the gift cards hereby agree and acknowledge to fully defend, indemnify and hold harmless Brinker Services Corporation, Brinker, Muy Mucho, and each of their related subsidiaries, parent companies and affiliates from any action, loss, damage or liability arising from, related to, or in connection with the sale of any gift card sold by a reseller, in any jurisdiction. For balance inquiries or customer service related to gift cards, you should contact Brinker Services Corporation at 1-888-532-6092. Gift cards may be redeemed for food and beverages at any participating Chili's® Grill & Bar, Romano's Macaroni Grill®, On The Border Mexican Grill & Cantina®, and Romano's Macaroni Grill®.
Limited User License for Access and Use
Muy Mucho grants you the limited, revocable (at any time, for any reason or no reason), non-transferrable, non-exclusive license to access and use the Muy Mucho Sites and Content for your own personal, non-commercial use, according to this Agreement. NO other use is permitted. Your access and/or use of the Muy Mucho Sites and Content beyond the scope of the limited license granted herein or failure to comply with all of the terms, conditions, and notices on the Muy Mucho Sites and in this Agreement will result in automatic termination of all rights granted to you, without notice. Except for the limited license granted herein, Muy Mucho does not grant you any express or implied rights or licenses under any patents, trademarks, copyrights, or other proprietary or intellectual property rights of Muy Mucho. You agree not to access or use the Muy Mucho Sites or Content in any manner that may overburden, damage, disable, or impair Muy Mucho's services, computer systems, networks, or the Muy Mucho Sites. You agree not to interfere or attempt to interfere with the proper working of the Muy Mucho Sites or access any unauthorized parts of the Muy Mucho Sites or Muy Mucho's services, computer systems, and networks. Access to and use of password-protected or secure areas of the Muy Mucho Sites is restricted to authorized users only, and you are solely responsible for maintaining the confidentiality and security of passwords, account information, financial information and other information and data you provide on the Muy Mucho Sites. You agree to notify Muy Mucho immediately of any unauthorized use of your passwords, account and/or financial information or accounts. You further agree not to use the Muy Mucho Sites or the Content for any unlawful purpose or a purpose which is prohibited by the Agreement. You are solely responsible for ensuring that your mobile device(s) and web browser are compatible with the Muy Mucho Sites prior to your use of the Muy Mucho Sites.
Submissions
All remarks, suggestions, ideas, graphics, and other data and information communicated by you to Muy Mucho and its Restaurants through your use of and access to the Muy Mucho Sites (collectively, "Submissions") will forever be the property of Muy Mucho. Muy Mucho will not be required to treat any Submissions as confidential. Muy Mucho will not be liable to you or any other individual or entity for any ideas used in its business (including without limitation, product, or advertising ideas) and will not incur any liability as a result of any similarities that may appear in future Muy Mucho operations with respect to such Submissions. Without limitation, Muy Mucho will have exclusive ownership of all present and future existing rights to Submissions of every kind and character without limitation. Muy Mucho will be entitled to use the Submissions for any commercial or other purpose whatsoever without compensation to you or any other person or entity sending the Submissions. You acknowledge that you are responsible for whatever Submissions you submit, and you, not Muy Mucho, have full responsibility for the message, including its legality, reliability, appropriateness, originality, and copyright. Each time you provide a Submission to the Muy Mucho Sites, you represent and warrant that you have the full legal right to provide the Submission. Muy Mucho expressly disclaims any duty, obligation, responsibility or liability with respect to any Submissions by you or any other user of the Muy Mucho Sites, and specifically disclaims any obligation to review, screen, post, refuse, remove, or edit any Submissions. The content of any Submissions are those of their author and do not necessarily reflect the views of Muy Mucho.
Brinker's Trademarks and Logos
The Chili's® trademarks and logos displayed on the Muy Mucho Sites and the Brinker Sites are registered trademarks, designs and logos owned by Brinker, which cannot be removed, used, deleted, uploaded, download, copied or republished in any manner without first obtaining Brinker's express prior written consent.
Proprietary Rights
You acknowledge and agree that Muy Mucho owns all legal right, title and interest in and to the Muy Mucho Sites and Content, including any intellectual property rights of Muy Mucho which subsist therein, whether those rights are registered or not, and wherever in the world those rights exist. The Muy Mucho Sites and Content are protected to the maximum extent permitted by law. Content displayed on the Muy Mucho Sites is protected by copyright as a collective work and/or compilation, and any reproduction, modification, creation of derivative works, copying, or redistribution, of the Muy Mucho Sites and/or Content, or any portions thereof, is expressly prohibited without first obtaining the prior express written consent of Muy Mucho. Muy Mucho makes no representation or warranty concerning any Third Party Content that may be referenced on, accessed from, or linked to the Muy Mucho Sites. The Third Party Content may be protected by various laws, rules and regulations, including, but not limited to, copyright as a collective work and/or compilation, and any reproduction, modification, creation of derivative works, copying, or redistribution, of any Third Party Content, or any portions thereof is expressly prohibited without first obtaining the prior written consent of the owner of the Third Party Content. You further acknowledge and agree that the Third Party Content may contain confidential information, and that you shall not disclose such confidential information without the prior written consent of the owner of the Third Party Content. Brinker and Muy Mucho may use outside third parties to provide services, such as marketing, shipping, credit card processing, newsletter fulfillment, and personalizations for services requested by you. Muy Mucho and Brinker expressly disclaim any liability to you with respect to your use of such third party services.

Any creation by you of hyperlinks to the Muy Mucho Sites and/or Brinker Sites is expressly prohibited without first obtaining the prior written consent of Muy Mucho and Brinker. The Muy Mucho Sites and Brinker Sites may be linked to other websites that are not maintained by Muy Mucho, Brinker, or either of their subsidiaries, parent companies and affiliates. Brinker and Muy Mucho express disclaim any liability related to the content, access and use of those websites and any Third Party Content thereon. The inclusion of any link to such sites does not imply endorsement by Brinker or Muy Mucho of those sites or any Third Party Content thereon.
Limitation of Liability
You expressly understand and agree that Muy Mucho shall not be liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages of any type whatsoever which may be incurred by you arising from, related to, or resulting from your access and/or use of the Muy Mucho Sites, the Content, and/or any Third Party Content, no matter how caused, and under any theory of liability whatsoever EVEN THOUGH CAUSED OR ALLEGED TO BE CAUSED BY THE NEGLIGENCE OR FAULT OF MUY MUCHO, OR ANYONE CLAIMING BY, THROUGH OR UNDER MUY MUCHO. Even if Muy Mucho is expressly advised of the possibility of such damages, this exclusion and limitation of liability applies to any and all causes of action, whether based on contract, tort, or any other legal theories.
Disclaimer of Warranties
You understand and agree that your use and access of the Muy Mucho Sites is entirely at your own risk. The Muy Mucho Sites and the Content are provided on an "as-is" and "as-available" basis, "WITH ALL FAULTS", without warranties of any kind, express, statutory or implied, OF ANY KIND APPLICABLE TO THE Muy Mucho Sites, content and any third party content, including but not limited to: warranties of merchantability, fitness for a particular purpose or use, accuracy, integration, completeness, AVAILABILITY, timeliness and non-infringement, ALL OF WHICH are expressly disclaimed to the fullest extent permitted by law. MUY MUCHO expressly disclaims that any content on the MUY MUCHO siteS provided to you by MUY MUCHO will be delivered free of ERRORS, MISINFORMATION, OR the rightful claim of any third person by way of infingement. Further, you agree to indemnfiy, defend, and hold MUY MUCHO harmless with respect to any and all claims of any third party arising out of your use of the site, content, and any third party content, EVEN THOUGH CAUSED BY MUY MUCHO'S OWN NEGLIGENCE. YOU AGREE TO INDEMNIFY, DEFEND (WITH COUNSEL ACCEPTABLE TO MUY MUCHO), RELEASE AND HOLD HARMLESS MUY MUCHO, AND MUY MUCHO'S AFFILIATES, PARENT COMPANIES, SUBSIDIARIES, OWNERS, PARTNERS, AGENTS, EMPLOYEES, REPRESENTATIVES, SUCCESSORS AND ASSIGNS (COLLECTIVELY, "MUY MUCHO PARTIES"), FROM AND AGAINST ANY AND ALL PAST, PRESENT OR FUTURE CLAIMS, DEMANDS, LOSSES, LIABILITIES, CAUSES OF ACTION, SUITS, JUDGMENTS, DAMAGES (WHETHER DIRECT, INDIRECT, SPECIAL OR CONSEQUENTIAL), COSTS AND EXPENSES (INCLUDING ATTORNEYS' FEES) ARISING FROM ANY OCCURRENCE, ACTIVITY, OR THING DONE, PERMITTED OR SUFFERED BY YOU, OR ANYONE ELSE CLAIMING BY, THROUGH OR UNDER YOU, RELATED TO, IN CONNECTION WITH, OR ARISING FROM YOUR USE OF THE MUY MUCHO SITES, CONTENT, THIRD PARTY CONTENT, AND PURCHASE AND USE OF ANY GOODS AND SERVICES FROM MUY MUCHO AND THE RESTAURANTS IN CONNECTION WITH THE FOREGOING, WHETHER ASSERTED OR UNASSERTED, WHETHER KNOWN OR UNKNOWN, IN LAW OR IN EQUITY, FOR OR BY REASON OF ANY MATTER, CAUSE, OR THING WHATSOEVER, OR DUE TO ANY OTHER ACT OR OMISSION BY YOU (OTHER THAN ANY LOSS ARISING FROM THE GROSS NEGLIGENCE OF ANY MUY MUCHO PARTY), EVEN THOUGH CAUSED OR ALLEGED TO BE CAUSED BY THE JOINT, COMPARATIVE, OR CONCURRENT NEGLIGENCE OR FAULT OF ANY MUY MUCHO PARTIES, AND EVEN THOUGH ANY SUCH CLAIM, CAUSE OF ACTION, OR SUIT IS BASED UPON OR ALLEGED TO BE BASED UPON THE STRICT LIABILITY OF ANY MUY MUCHO PARTY. THIS INDEMNITY PROVISION IS INTENDED TO INDEMNIFY THE MUY MUCHO PARTIES AGAINST THE CONSEQUENCES OF THEIR OWN NEGLIGENCE OR FAULT AS PROVIDED ABOVE WHEN MUY MUCHO OR ANY MUY MUCHO PARTIES ARE JOINTLY, COMPARATIVELY, OR CONCURRENTLY NEGLIGENT WITH YOU. YOU ACKNOWLEDGE AND AGREE THAT BY ACCEPTING THE TERMS OF USE IN THIS AGREEMENT, YOU ARE RELINQUISHING YOUR RESPECTIVE LEGAL AND EQUITABLE RIGHTS WITH RESPECT TO ANY AND ALL PAST, PRESENT, OR FUTURE CAUSES OF ACTION OR LEGAL CLAIMS WHICH MAY BE ASSERTED BY YOU, OR ANYONE CLAIMING BY, THROUGH, OR UNDER YOU, AGAINST ANY MUY MUCHO PARTIES, INVOLVING YOUR ACCESS TO AND USE OF THE SITE, CONTENT, ANY THIRD PARTY CONTENT, AND PURCHASE AND USE OF ANY GOODS AND SERVICES OF MUY MUCHO AND/OR THE RESTAURANTS IN CONNECTION WITH THE FOREGOING.
Privacy Statement; Collection of Personal Information
The Restaurants use web and mobile application based remote ordering services to allow you to place orders through the Muy Mucho Sites. As a result of those orders, Muy Mucho collects certain personal information from you, which is described below. By accessing the Muy Mucho Sites you are consenting to the practices described in this privacy statement. When you use the Muy Mucho Sites, Muy Mucho may ask you for personal information to provide goods and/or services, and/or carry out a transaction that you have requested. The personal information may include: contact information, such as your name, address, telephone number and email address; financial information, such as your credit card or bank account information; user IDs and passwords; billing and transaction information; information that assists us in determining the goods and services that best meet your needs, order history, and other data. You are not required to provide any of this information; however, if you do not, Muy Mucho may not be able to provide you with some requested goods or services. Muy Mucho will also collect certain standard information that your web browser sends to every website you visit, such as your Internet Protocol (IP) address, your browser type and capabilities, your operating system, the date and time you access the site, and any website from which you may have linked to the Muy Mucho Sites. In some instances, the Muy Mucho Sites may include various location-based features, such as determining your state and country of origin. To provide these location-based features, Muy Mucho and the Restaurants may collect, use and share your location data, including the real-time geographic location of your mobile device if used to access the Muy Mucho Sites.
Use of Personal Information
The personal information that Muy Mucho collects will be used to deliver Muy Mucho's goods and services, answer customer service requests, update you on new goods and services, provide you with service and support, and to provide other business services to you. Muy Mucho will you're your personal, financial, and other order information to the Restaurants you order from using the Muy Mucho Sites. Additionally, Muy Mucho may contract with other individuals and companies in order to provide you with its goods and services. Muy Mucho provides these individuals and companies with only those portions of your personal information which Muy Mucho deems necessary to provide you with requested goods and services. The use of your personal information by such third parties is governed by their privacy policies and statements. Muy Mucho may also disclose some of your personal information to financial institutions, government agencies, and shipping companies in order to complete any transactions requested by you or provide goods and services. Muy Mucho may disclose your personal information if it is necessary in order to provide products or services to you, including purchaser verification, authentication, geolocation, and authorization for any orders (and contacting you when necessary. Muy Mucho may release any of your personal information in order to comply with law, enforce of apply the terms of this Agreement, and/or to protect the rights, property and safety of Muy Mucho, customers, employees, clients, or others. Restaurants may use your personal information to contact you concerning products, services and promotions which may be of interest to you. You may choose at the time of registering an Account on the Muy Mucho Sites to join Chili's® Email Club to receive information by email concerning specials, exclusive offers, and other information. By requesting to join Chili's® Email Club you may be agreeing to provide personal information with third parties with whom Muy Mucho and Brinker contract to provide you with goods and services, and such third parties' use of your personal information will be governed by such third parties' own privacy policies. Muy Mucho expressly disclaims any liability related to your participation in the Chili's® Email Club, and you must look to such third parties to determine whether you agree to their terms of use and privacy policies. You do not have to agree to join Chili's® Email Club to use the Muy Mucho Sites. From time to time, the Muy Mucho Sites and/or Brinker Sites may also request information from you via surveys or contests. Participation in these surveys or contests is completely voluntary and thus you have a choice whether or not to provide your personal information.
Access To and Accuracy of Your Information
Muy Mucho strives to accurately record your personal information provided on the Muy Mucho Sites. To protect your privacy, Muy Mucho may take reasonable steps to verify your identity, such as requiring the use of a user ID and password before granting access to your data. In order to review and/or change the personal information that you have provided to Muy Mucho, you may contact Muy Mucho by telephone or email at the contact information provided on the Muy Mucho Sites.
Account Registration, Use and Security
Use of the Muy Mucho Sites requires that you register and/or create an account ("Account") or use the Muy Mucho Sites as a guest. To register and create an Account, you must select a User ID and password for the Account, and provide certain personal and/or financial information. In consideration of the limited license granted to you to access and use the Muy Mucho Sites and Content as provided herein, you agree to: (1) provide true, accurate, current and complete information about yourself in the registration process; (2) not use any other person or entity's personal or financial information as a part of your registration; and (3) maintain, secure, keep confidential, and regularly update the personal and financial information you provide so that it is accurate and current each time you access and use the Muy Mucho Sites. You will have the option when registering your account to provide identifying information about your vehicle, which is used for curb-side service at some Restaurants; however, you do not have to supply this information to use the Muy Mucho Sites. Further, you will have the option when creating your Account to store your financial information as a part of your Account; however, you do not have to store this information in order to use the Muy Mucho Sites.
Muy Mucho uses industry-standard technical safeguards to protect your personal and financial information. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we will attempt to protect your personal and financial information, Muy Mucho cannot ensure or warrant the security of any information you transmit to us or any information provided online, and you do so at your own risk. You are solely responsible for maintaining the confidentiality and security of your Account, and personal and financial information you provide. Further, you are solely responsible for all activities that occur using your Account, personal information and/or financial information, and for any other actions taken in connection with the Account. Muy Mucho will not be liable for disclosures of your personal and/or financial information due to errors in transmission or unauthorized acts of third parties. Once we receive your transmission, we will use commercially reasonable efforts to ensure its security on our systems by making reasonable efforts to protect the information. You agree to (1) immediately notify Muy Mucho of any known or suspected security breaches, loss, theft, and/or unauthorized access or disclosure of your Account, and your personal and financial information; and (2) ensure that you log out of your Account and fully exit at the end of each session each time you visit the Muy Mucho Sites. Muy Mucho will not be liable for any injury, loss or damage of any kind arising from, relating to or connected with your failure to comply with this Agreement and/or any acts or omissions by you and/ or any other person or entity using your Account, personal information and/or financial information.

Applicable Law
All matters related to your access and/or use of the Muy Mucho Sites, Content, and this Agreement, shall be governed by and construed under the laws of the State of Texas, without regard to conflicts of law rules. Any action or proceeding arising out of or related to your access and/or use of the Muy Mucho Sites, the Content, and this Agreement, shall be brought in the federal and state courts of Dallas County, Texas.
Termination of Use
You agree that Muy Mucho may, in its sole discretion, at any time, terminate or limit your access to or use of the Muy Mucho Sites and Content at any time, for any reason or no reason. You agree that Muy Mucho shall not be liable to you or any third party for any termination or limitation of your access and/or use of the Muy Mucho Sites and Content.
Deleting or Updating Personal Information and Preferences
You may contact Muy Mucho using the contact information on the Muy Mucho Sites at any time to update your personal information, change your preferences, and/or delete your personal and financial information from Muy Mucho's systems. You may also update your Account information at any time by accessing your Account on the Muy Mucho Sites. When personal and/or financial information has been provided to the Restaurants and/or any third party, you must also contact those entities to update, change and/or delete any of your personal and/or financial information provided to them.
